West Rockhill’s current website update says the initial Heritage Meadow special-exception hearing scheduled for September 2, 2026 was postponed at the applicant’s request. It describes a tentative May 2027 hearing and the possibility of an earlier written request. That is a schedule update, not a project approval.

A separate Township board page still carries an earlier June hearing notice for the battery proposal. Before relying on a date in an old notice or presentation, ask the Township for the current case schedule and ask the company which version it is using.

For your property, request a simple written update: the next application step, who controls it and the expected effect on the land agreement. Keep the update with the agreement rather than relying on a general statement that the project is moving forward.

Put the hearing date beside the option dates

Make a short timeline from the actual offer. Include the option start, expiration, extension notices, extension payments and any date tied to an approval. Then add the current public-review schedule. A gap between the two deserves an answer before you sign an extension.

Ask whether the company may extend on its own or needs your agreement. What must it send, when must it send it and when is the payment due? If the notice arrives but the payment does not, have your adviser check what the contract says happens next.

Discuss the time you are giving up. Would a longer reservation interfere with a sale, refinancing, a farm tenancy or a planned building? If only part of the property is needed, ask whether the same reservation must continue over the whole parcel.

A developer’s agreement with the Township about hearing timing does not tell you whether your private option has been extended. Read the private document and any amendment before treating both deadlines as the same.

Agree what can happen on the land while everyone waits

Ask which visits and studies are planned during the delay. Mark survey access, test locations, temporary parking and any work area on a drawing. A reservation of land and permission to disturb it need clear terms.

Discuss notice before each visit, the people allowed on site and how vehicles reach the study area. If you have livestock, crops, tenants or a shared driveway, explain the arrangements that need to be respected.

For sampling or excavation, ask who restores the ground, replaces damaged fencing and pays for crop loss or other damage. Identify the person to contact if work goes beyond the agreed area.

Keep a dated record of the condition before work and any agreed repairs afterward. Ask how unfinished repairs are handled if the company ends the option or passes the project to another company.

If the company asks to widen a route or add another field while waiting, review that as an additional request. Compare it with the existing access permission and payment terms.

Keep the application drawing separate from a promise of approval

The Township’s published use provisions distinguish a special exception, a conditional use and a zoning permit. They also point to other applicable plan requirements. Have the Township confirm the route for the actual design; another application’s classification does not qualify your parcel.

The published zoning application provisions call for information about the proposed use and layout, including access, buffers and other site details. For the drawing you are asked to support, mark the equipment area, retained uses, entrance and electrical route.

Ask the company to send revisions before it submits them. What changed from the version you saw: equipment, access, land area or proposed conditions? Discuss who can approve changes affecting your property and what authority an agent would receive.

If someone says approval has been obtained, request the dated decision, conditions and referenced plan. Ask what reviews remain before construction and which expenses or obligations could affect you.

The connection route needs a separate explanation. Ask where the cable would run, whose land it crosses and whether a changed route would need additional rights from you. A hearing date does not answer those questions.

Decide how you will receive updates and end an unfinished proposal

Agree on a contact and a reporting interval. Ask for a written update when the hearing moves, the layout changes, a study is delayed or the company wants more time. A practical update should say what changed and what it means for your agreement.

Keep your own document set: signed option or lease, amendments, authority forms, drawings, payment records and public decisions. The Township’s code describes zoning application documents as public records. Before information is filed, ask what the public submission will contain.

Check costs separately from your income. Who pays the application, consultant and study bills? Could any document make you responsible for a cost? Ask for that answer before signing paperwork or paying a bill sent in the project’s name.

If the proposal stops, ask who withdraws the application, repairs study damage and releases any recorded rights. Identify the deadline for each task and the documents you receive when it is complete.

If the company wants to transfer the project, ask which company takes over your payment, repair and release obligations. A new project contact is useful, but it should accompany a clear explanation of the continuing agreement.
