Ask the company to identify the permits for its actual design and show what has been issued. Bexar County’s posted materials link Public Works verification with Fire Marshal permit issuance where that process applies, and distinguish foundation work from vertical construction. Plans under review do not by themselves authorize clearing, grading or construction. Match the approved work to the land agreement, and settle access, costs and responsibility before work begins.

Ask which approvals apply to this design

Have the company describe what it wants to build on your land. Ask for a map showing batteries, electrical equipment, any building or foundation, the entrance, drainage, lighting and the connection route. Include temporary construction areas and mark the uses you want to retain.

Ask the team to confirm the property’s actual jurisdiction and the offices that will review the proposal. County and city requirements can overlap outside city limits. Bexar’s public Development Services descriptions discuss city extraterritorial jurisdiction, road work and conditional City of San Antonio stormwater and military-area documents. Those descriptions do not classify every battery proposal the same way.

The Fire Marshal page directs applicants to Public Works for building-permit authorization. The Public Works form distinguishes vertical building construction, foundation-only work, and changes of occupancy with or without site work. Have the project team establish which categories apply to its equipment and structures rather than selecting one from a general checklist yourself.

Ask for a simple list of the decisions needed, who is preparing each submission and what remains unresolved. You can use that list to understand the proposal without becoming the person responsible for its engineering or permit applications.

A review submission is not permission to begin work

The posted Public Works form says the Fire Marshal’s Office must receive the completed verification before issuing its permit where that process applies. Bexar’s public portal similarly describes a signed Public Works verification being sent to the Fire Marshal and applicant before permit issuance.

The linked process packet also contains diagrams marked Existing and Proposed. The proposed sequence discusses accepting plans for review while Public Works verification is being completed, describing the application as at risk until the verification is fully executed. Those diagrams are not proof of an adopted timetable or a guaranteed approval deadline. Ask the offices what sequence they currently allow for this project.

If the company says its plans have been submitted or accepted, ask what that means. Is the application complete? Have review comments been resolved? Is Public Works verification signed? Has the applicable permit actually been issued, and what activities does it authorize?

Keep study access separate from construction permission. An agreement allowing a survey or site visit should not quietly become permission to clear trees, build a pad or install equipment. Discuss the specific activities, routes, notice, damage repair and any approval required from you before work changes.

The county application includes an acknowledgment that the work described cannot proceed until approved plans and a permit are received. Ask the company to supply the actual authorization for the activity it wants to perform, and have your adviser compare that with the access or construction rights in the private agreement.

Check site preparation as carefully as the battery installation

The March 2024 verification form’s foundation-only category expressly includes building-pad preparation without vertical construction. That is a reason to ask about early work separately. Do not assume that a company can begin grading or pouring foundations simply because equipment installation will happen later.

Ask for a construction sequence that shows clearing, earthwork, drainage, foundations, deliveries and installation. Identify the permission needed for each activity, which contractor will do it and who will check compliance. Have the team explain any change in sequence before it affects the property.

The same form connects the project narrative and site plan with permitted activities. Its stormwater section says those activities should match, and its floodplain section also calls for consistency. Ask whether the drawings being used on site are the same design that was reviewed, including work outside the battery fence.

Bexar’s public Development Services description says its right-of-way permit applies to work in a right-of-way maintained, or proposed to be maintained, by the county. The verification form discusses utility connections, driveways and other road work, plus temporary construction access under a stated condition. Have the company confirm the actual road authority and permissions for both the permanent entrance and construction route.

Decide how construction traffic will share gates and access with you. Agree on notice, fencing, keeping existing uses accessible and repairing damage. Public road permission does not settle the company’s private right to cross land you retain or a neighbor’s property.

Existing property records may not answer the new-use questions

Ask whether an earlier plat, drainage report or permit assumed the proposed use. The March 2024 form calls for an updated drainage report in specified situations, including a changed use, a drainage system not previously identified or a report requested by City of San Antonio Public Works. It directs the team to consider whether existing and receiving drainage systems can handle the new flow.

The form also discusses subdivision documentation and checking the layout against proposed easements or right-of-way dedications. Ask for the relevant property records and a map showing how the new design fits them. A record from a previous development should not be treated as approval of a different footprint or use without review.

Its floodplain row describes a permit requirement for property containing, or within one hundred feet of, a mapped FEMA floodplain for the listed permit types. Have the project team and reviewing office determine applicability to the actual property and work. That wording is a review condition in this form, not a universal battery setback or proof that a particular parcel can or cannot flood.

For property in the City of San Antonio’s extraterritorial jurisdiction, the form asks for specified city stormwater documentation. It separately addresses military-protection compatibility or lighting documentation as applicable. Ask how any relevant decision affects lighting, drainage, equipment location and land you expect to keep using; this guide does not determine those areas from your address.

Keep septic questions tied to the proposed facilities. The form requests sewage documentation if the property will have an on-site sewage facility and asks that its treatment and disposal areas fit the new use. That does not mean every battery site needs septic, nor does the general form provide the complete safety requirements for battery equipment.

Understand the signature, costs and closeout responsibilities

The downloaded building/system application identifies the building owner, business owner, design professional and contractor separately. Its responsible-party signature includes acknowledgment that the completed application is correct and applicable code provisions will be followed. If you are asked to sign, understand the capacity in which you are signing and what statements you are making.

The application also assigns the applicant responsibility for communicating plan noncompliance to involved parties. Ask who receives comments, arranges corrections and keeps you informed. A private promise that the company handles permits should identify those tasks and address costs if the plans need to change.

The Fire Marshal page and application describe fees as nonrefundable. Ask the office to confirm the current charges for the actual permits; this guide does not provide a battery fee quote. Agree who pays for applications, engineering, revisions, inspections and any work that has to be corrected, including what happens if the proposal is canceled.

The application calls for as-built plans before an occupancy or compliance certificate is issued. Ask which final inspections and documents apply to the approved project and who will provide them. Construction completion, a permit receipt and final certification are different milestones.

Confirm the current packet before relying on its page order or submission instructions. The webpage describes a Public Works authorization as the application’s first page, while the linked file reviewed for this guide begins with the May 2019 application. Ask the company to obtain the current complete forms and instructions from the office rather than assume an older downloaded file contains everything required.

Keep grid connection and private agreement decisions separate

The Public Works verification form lists a CPS address verification letter among supporting documents. An address letter is not proof of electrical capacity, an approved battery interconnection or a completed utility agreement. Ask separately about the project’s connection application, studies, costs and remaining utility decisions.

Compare the approval work with the option or lease dates. Check how long the company can reserve the land, what it pays during studies, when operating payments begin and what permits or utility outcomes allow it to proceed. An application under review should not be described as the final approval milestone in your agreement without a clear definition.

If drainage, access or project safety review changes the layout, ask how the agreement handles additional land and restrictions. Confirm whether changes need your written approval, how compensation is determined and whether a connection route outside the lease area requires separate rights.

Discuss continuing maintenance and removal as well as initial approval. Identify who cares for roads, drainage, fencing and other facilities on retained land, how duties continue after a project transfer, and what condition the company must leave if development stops or the lease ends.

Questions landowners ask

Does accepting plans for review authorize construction?

No. Ask which applicable permits have actually been issued, which design they cover and what work they authorize. The linked packet discusses an at-risk review process in a diagram marked Proposed; that is not permission to start work or proof of a guaranteed timetable.

Should I ask about grading before equipment installation?

Yes. Bexar’s posted verification form distinguishes foundation-only work, including pad preparation, from vertical construction. Have the team confirm the current approvals for each early activity and the access rights agreed with you.

Does a CPS address verification letter confirm grid capacity?

No. Address verification and battery interconnection answer different questions. Ask separately about the connection studies, upgrade costs and utility decisions needed for the project.

Can old property permits and plans cover the new proposal?

Have the reviewing offices and project team confirm that. Changed use, new drainage work or a different layout may require updated documents. Check the design against existing easements, access and property records.

Who should handle permit signatures and corrections?

Clarify the owner, applicant, company and contractor roles before signing. The application includes responsible-party acknowledgments and duties. Ask your adviser to compare those with the company’s written commitments on costs, corrections and final documents.
