If the developer mentions tax abatement, ask for the property description, the proposed improvements and the actual stage of the request. An application, a reinvestment zone and an executed agreement are different records. Find out which one supports the developer’s claim.

Starr County’s posted guidelines reserve discretion to consider the project and negotiate its terms. They discuss economic benefits, financial capacity and other review factors. The existence of the policy is not a promise that a particular battery will receive an incentive.

Read the obligations behind an owner signature

Ask why your signature is needed and in what capacity you would sign. Are you approving a description, authorizing the applicant, or becoming a party to an incentive agreement? Obtain the complete document and attachments before answering.

The posted guidelines say an agreement for an abated leased facility is to be executed with the lessor and lessee. They describe property access for inspections, limits on use and annual certification of compliance. Do not assume that every obligation belongs solely to the project operator.

Have your private agreement assign responsibility for applications, records, reports and notices. Ask who will supply information that you cannot independently verify, who keeps copies and who responds when the county requests access. Clarify whether you would be asked to certify statements about construction or operations.

Inspection access should be understood alongside the uses you retain. Ask how gates, contractor visits and emergency contact arrangements would work while the project is built and operated. Separate the access required by public paperwork from any broader rights requested in the lease.

Plan for a new project company and unfinished connection work

A battery project may change hands before or after construction. The posted incentive guidelines describe county approval of an assignment, review of the successor and acceptance of existing obligations. That process is separate from the right to assign your private lease.

Ask what notice and consent the lease provides, whether the incoming company assumes all duties and whether the original company remains responsible for anything. Keep payment, repair and reporting obligations clear if the operator or contractors change.

County incentive paperwork also does not reserve electrical capacity. Request the proposed connection point, study status, upgrade work and route rights. A nearby line and a planned project elsewhere in the county do not settle the connection for your tract.

Put the remaining reviews and studies beside the option deadline. Decide how long the land can be held, what an extension costs and how the rights end if the project does not move forward. This gives you a way to assess the proposal before a long reservation restricts other uses.
