What should you check before offering Jack County land for battery storage?

Start with the proposed site and access route, then find out which reviews still apply.

Could my land work?

Jack County’s Public Works page says the county does not issue building permits or certificates of occupancy. That does not mean a proposed battery site has no review requirements. Its Land Development page addresses private and commercial development, subdivision rules and permits before construction in recognized flood zones. Identify your parcel’s authority, show the equipment and access route on a sketch, and have the company confirm the requirements for its actual proposal.

Understand what the county’s building-permit statement covers

The Public Works page states that Jack County does not issue building permits or certificates of occupancy and has no county zoning requirements. The same page says the department regulates on-site sewage facilities and development in special flood-hazard areas in the unincorporated county. Read those statements together when discussing a proposed battery site.

The Land Development page describes administration of development and subdivision regulations for private and commercial development. It also says construction within a FEMA-recognized flood zone requires a permit before construction starts. A company should explain how these requirements affect its proposal, rather than relying on the absence of an ordinary building permit.

Begin by locating the tract and confirming whether a municipality or other authority has a role. A Jacksboro mailing address or a county tax record does not settle that question. Ask the company to identify the offices responsible for the parcel and the proposed work.

Request a short list of the decisions still needed before clearing, grading, road work and equipment installation. Keep county development review, private land rights and electrical connection milestones separate. Progress in one does not automatically establish the others.

Show the entrance and the land you intend to retain

The county’s property-address guidance asks for a sketch or site plan showing the structure’s placement and orientation, the driveway from the street, and applicable property lines. That is a useful starting point for an owner conversation too: it helps reveal whether the proposed entrance and project area fit the land you are willing to discuss.

Ask the company to show permanent equipment, temporary construction space and the access route. Mark your home, barns, fields, gates and any land you want to keep using. A sketch for an early discussion is different from a finished engineering plan or recorded plat.

The address guidance notes that a corner location or a re-platted lot can affect an address request. Tell the company about those circumstances if they apply. Have it coordinate the proposed entrance and location with the appropriate office rather than assuming the existing address serves a new project area.

Do not commission a new survey simply to send an initial Sunland inquiry. An existing map or clear location is enough to begin. If detailed drawings become necessary, establish who prepares them, who pays and what permission is needed for visits or survey work.

Check an access easement before promising a route

The county’s address answer specifically discusses property reached through another property’s easement. It asks for a copy of the granted easement and a survey or site plan showing it. If that describes your land, locate the existing document and show the route accurately.

Having an easement does not answer every question about using it for a battery project. Ask your adviser to examine the rights granted and the proposed use, including construction deliveries, operating access and any widening or improvements. Do not promise the company a broader route than you have the right to provide.

If access crosses land you do not own, have the company identify any additional agreement it needs and who will obtain it. An address assignment or a route on a drawing does not itself grant permission from another owner.

The posted address guidance gives Nortex Regional Planning Commission as the contact, at (940) 322-5281, extension 109. Confirm the current process and whether a separate project address is needed. You do not need to request one before contacting Sunland about the property.

Settle the land-division question from the actual arrangement

The county links subdivision regulations dated August 17, 2020. Their plat provisions address divisions of a tract outside municipal corporate limits, with exceptions and a process for discretionary exceptions. Ask which current rules apply if the company wants to buy part of the tract, change a lot boundary or use another arrangement involving a division.

The posted document discusses descriptions of less than a whole parcel and lease/purchase agreements among the arrangements considered. That is a reason to give the reviewing office and your adviser the proposed documents, not a basis for declaring that every battery lease requires a plat.

The exceptions have conditions. The agricultural exception, for example, addresses the layout and primary use, and the document discusses what happens if the qualifying use ceases. Do not assume an existing farm or ranch use provides an automatic exception for a different development.

Ask the company for the authority’s answer, the basis of any exception and the records that document it. The posted rules also address municipal extraterritorial jurisdiction and interlocal agreements. Current requirements and the authority for your location should be confirmed before relying on the older document.

The current county directory lists the County Judge’s office at (940) 567-2241. The Land Development page directs flood-zone location questions to that office as well. Keep construction review and ongoing responsibilities separate

Ask for the flood-zone guidance that applies to the actual site layout before work begins. Identify the equipment, grading, roads and other construction being proposed. The county page provides a starting requirement, but it does not give a complete battery permit checklist or determine that your property is outside a flood zone.

The Public Works procedures directory contains sewage and septic documents. The Land Development page says structures using septic systems need a permit. Have the company explain any proposed facilities and the review they need; those forms should not be treated as a general battery-project approval package.

The subdivision document says plat approval does not mean the county accepts subdivision roads for maintenance. It describes a separate application, review and recorded order. Ask for that decision if the company says a road will be maintained by the county, and settle responsibilities for private roads and entrances in your agreement.

Discuss repairs, drainage, gates and access to retained land during construction and operation. Also put removal and restoration obligations in the land agreement, including who is responsible if the project stops or is transferred. A public review does not replace those private commitments.

Finally, ask the company what has been confirmed about connecting the proposed batteries to the grid. County review and a nearby power line do not establish available capacity or a construction date. Understand how remaining studies affect the length of an option and the payments you would receive.

Questions landowners ask

Does no county building permit mean the site can be developed immediately?

No. The county also administers development and subdivision rules and requires permits before construction in recognized flood zones. Have the company confirm the parcel’s authority and requirements for each proposed activity.

What should an early site sketch show?

Show the proposed equipment area, property lines and driveway from the street. Mark the buildings, entrances and land uses you intend to retain. The county’s addressing answer specifically asks for structure placement, driveway location and applicable property lines.

What if my land is reached through another property?

Locate the granted easement and show it on the existing survey or sketch. The county’s addressing guidance requests those materials. Have your adviser check whether the rights cover the company’s proposed access and improvements.

Do I need a subdivision plat for a battery lease?

This guide does not determine that. Give the company’s actual arrangement to the county and your adviser, including any division, changed boundaries or proposed conveyance. Ask how current requirements and any exceptions apply.

Does plat approval mean the county will maintain the road?

The posted subdivision rules say it does not. They describe a separate review and recorded order for county acceptance. Request the actual decision and agree who maintains private access.

Do I need to request a new address before contacting Sunland?
