Find out which rules apply where the equipment would sit
A Fannin County address is a useful starting point, but it does not tell you everything about a battery proposal. Pinpoint the tract, the area being considered for equipment and the entrance. If a cable would cross another property or road, include that route in the first discussion.
The county’s Development Services page provides separate resources for Bois d’Arc Lake zoning, Lake Ralph Hall zoning and city extraterritorial jurisdictions. It links to city agreements and some maps. Ask the developer to identify the current city, county and lake-area review that applies to each part of the proposed work.
The posted lake zoning documents refer to official district maps and records of amendments. A future land-use drawing and the current zoning district should not be treated as interchangeable. Have the actual tract checked against the current official map before relying on a proposed use or a district name.
Let the company know where you farm, live, keep livestock or plan to build. Ask for a drawing that leaves those areas recognizable. A useful review explains both where a battery might go and how you would continue using the rest of the land.

Ask how the proposed battery would be classified
The two posted lake zoning documents include use charts and a section on new or unlisted uses. That section describes classification by the Commissioners Court and a zoning text amendment when the use cannot be classified under an existing listed use. It is a reason to ask about the actual proposal, not to decide its category yourself.
Have the company explain the proposed equipment, charging and discharge activity, operating hours and utility route to the reviewing authority. A term such as utility, warehouse or storage in a document does not by itself establish how a battery installation would be treated. Request the basis for the classification and any conditions that apply.
If a special-use permit, amendment or other review is needed, ask who prepares the application, pays for it and follows up. Before signing as an owner or authorizing an agent, understand the drawing and the authority being requested. The permission to submit an application should be considered separately from a lease or sale.
The posted Bois d’Arc packet contains amendments through August 2023, and the Lake Ralph Hall packet includes June 2023 amendments. Have later changes checked for the property. These posted resources do not establish that a battery has approval on your land.

If the deal divides your land, review the division before committing
A proposal for part of your property can take different forms: a lease area, a separate tract to be sold, or an access or cable easement. Ask the company to show which arrangement it wants and what you would retain. The answer matters for surveying, access, payment and any review of a land division.
The county’s Development Services page links a subdivision packet dated September 29, 2026. Its applicability section discusses divisions outside incorporated municipalities, platting and conditional exceptions. An acreage figure alone does not explain whether a particular arrangement qualifies for an exception; roads, access and other conditions can matter.
The packet’s amendment log records recent changes to exceptions, fees and lake-related review. An older handout or a remembered exemption may not describe the current process. Have a surveyor and the appropriate reviewing office check the proposed division and any claimed exception before the deal relies on it.
Ask who pays for the survey, review and any required improvements. Check that your retained tract will still have usable access and that the company’s entrance or utility rights will not prevent the uses you want to keep. A public plat approval does not settle your private price, rent or repair protections.

An existing farm entrance may need changes for equipment deliveries or maintenance vehicles. Ask the company to explain the route, turning space, gate width and drainage it expects to use. Identify whether the entrance meets a county road, state road or another authority’s road.
The county’s posted right-of-way policy describes a culvert process involving the owner, plans and the precinct commissioner. It discusses installation at the owner’s expense, inspections and the cost of correcting work that differs from the approved location or grade. Discuss who would carry out and pay for these duties under your agreement.
The policy treats changes to an existing culvert differently from a new installation, while still calling for commissioner contact before the changes. Do not read a permit exception as permission to change drainage without review. Have the current requirements confirmed for the entrance the developer actually proposes.
Keep records of the entrance and drainage before work starts. Ask who fixes damage from deliveries, clears obstructions and restores access after construction. If the battery company hires a contractor, identify the company that remains responsible to you after that contractor leaves.

A road crossing and a grid connection need separate answers
Follow the proposed electrical route beyond the fenced equipment. Ask which roads and private properties it crosses, who will own the facilities and who obtains each permission. Those rights can affect retained land even when the battery itself occupies a small area.
The posted county right-of-way policy says a permit does not grant a right, title or easement in the road. It also discusses utility relocation at the utility company’s expense if later road work affects the facilities. Ask how the company would handle relocation, maintenance and restoration without leaving you with unexplained obligations.
The policy calls for work drawings and addresses traffic control and detours where appropriate. That construction review does not establish electrical capacity. For the battery, request the proposed connection provider and point, remaining studies, upgrades and evidence that the planned charging and discharge can be accommodated.
Connect the schedule to your agreement. If studies or approvals take longer, how long can the company reserve the property, what does an extension cost and when does rent begin? Also settle removal and restoration funding. Permission for a road crossing does not answer those private payment and end-of-project questions.

Start with your location and what you want from the property
The form on this page lets you send your contact information and property location for a first discussion. Acreage, a parcel number or a nearby road can help, but you do not need a finished site plan to ask whether battery storage is worth investigating.
Tell us whether you would consider a lease, a sale or only part of the tract. Describe any home, fields, gates or future plans that need to be protected. If you already have an offer, mention questions about the proposed land division, entrance, cable route or owner signatures.
You are asking about the property, rather than authorizing construction or giving a company access. Any later site visit, application authority or agreement should be explained separately. Suitability still depends on the actual land, applicable review and a workable connection.
Questions landowners ask
Do lake zoning rules cover every Fannin County property?
The county posts separate lake-area zoning resources and official-map provisions. Have the actual tract, equipment area and routes checked for the current boundary and district, along with any city or county review. A county address alone does not settle applicability.
Can I assume a battery counts as a permitted utility use?
Ask the reviewing authority how the actual proposal is classified. Both posted lake documents include a process for new or unlisted uses. A familiar category name does not establish that a battery is permitted or that no further review is needed.
Which subdivision document should a proposal use?
Development Services links a packet dated September 29, 2026, including recent amendments. Have the current requirements checked when the proposal is reviewed. Older forms or remembered exceptions should not be the sole basis for dividing the property.
Does considering part of my tract automatically require a plat?
The answer depends on the arrangement and applicable rules. Distinguish a lease area, a separate tract sale and easement rights, then have the proposed division and any exception checked. Do not assume that acreage alone answers the question.
Who pays for an entrance or culvert change?
Have the agreement name who prepares plans, arranges review, installs the work, pays the costs and corrects problems. The posted county policy discusses owner expense and inspection responsibilities. A developer’s private promises should address those duties clearly.
Does a county road permit give the company an easement or grid capacity?
No. The posted policy distinguishes a work permit from rights in the road. Private easements and the battery’s electrical connection need their own review and evidence. Ask about the route, facility owner and connection provider separately.
