Match the project to the parcel
The county’s May 8, 2024 record identifies Bethlehem Road Energy Center at 8140 and 8150 Bethlehem Road under PFR2024-00001. Its July 16, 2025 record separately identifies Manassas Battery Energy Storage System at 8400 Bethlehem Road under PFR2025-00010. Both record favorable public-facility review findings concerning the Comprehensive Plan.
Ask for the address, parcel number and filing reference used in an offer. Compare them with the drawing and land description. A nearby project or shared road name should not be substituted for the records covering your property.
If someone says a project is approved, ask which project and which decision. Request the completed resolution and any later conditions. A staff recommendation or proposed resolution in an application packet can look similar to the final document, so check the actual outcome.

Identify the different companies and their roles
The Railroad and Bethlehem project website attributes the proposal to East Point Energy and describes a connection to an existing NOVEC substation. The separate Manassas staff packet identifies Lightshift Energy’s request and describes storage serving NOVEC on a county-owned parcel. These records concern different arrangements; a utility name alone does not identify the party to your agreement.
Write down who is approaching you, who would sign the option or lease, who would own the equipment and who would operate it. Ask whether those are the same company. If a project company is signing, ask how its relationship to the wider business is documented.
Ask your agreement reviewer to explain any guarantee, transfer provision or continuing responsibility. Public project descriptions do not establish who pays your rent, repairs damage or funds removal. Those obligations need to be clear in the proposed arrangement.

Understand what public-facility review establishes
The county explains that public-facility review concerns consistency with the Comprehensive Plan. Its guidance provides a determination request for uncertain cases and says an exception from PFR does not remove the need for relevant building, land-disturbance and other permits.
For your proposal, ask the team to identify its current review route, the decisions already completed and the approvals still needed. Have it explain how the use and design are classified. Another battery’s route should not be treated as permission for every vacant, agricultural or industrial parcel.
Keep planning, construction and electrical steps separate in the schedule. A favorable planning finding does not show the cost of connecting another property or establish that an operator is ready to start paying rent. Ask for the document supporting each milestone described to you.

The May 2024 Bethlehem Road record describes access through a private road. That is a useful reminder to review supporting rights, not a model that automatically applies to another property. Ask which entrances, drives and adjoining rights the actual project requires.
Put equipment, electrical work, delivery routes and temporary construction areas on one drawing. Mark tenants, business circulation and land you want to retain. If any route crosses someone else’s property, ask who obtains the consent and what happens if it is unavailable.
For example, a developer may propose an unused yard but need trucks to cross the driveway used by your tenant. Discuss the delivery schedule, repairs, emergency access and later maintenance before reserving the area. Compare those answers with the access terms you are asked to sign.

Compare the project schedule with your payments
Ask what is paid when you sign, during investigations and when a lease begins. Identify which event starts rent and which events allow extensions. Compare the time requested with your own plans for selling, leasing or improving the property.
If the project is delayed or cannot proceed, ask when the reserved rights expire and how recorded documents are released. Discuss restoration of testing work separately from removal of an operating facility. Work can affect your land before equipment arrives.
Keep the signing company’s notice details current. Ask how a transfer would affect payment, insurance, repair and removal obligations. A familiar developer brand or nearby utility does not replace the actual terms defining responsibility.

Check the agreement signer and payment terms. A utility’s project role does not by itself establish that obligation.
Can I ask about part of a working property?
