The Elk Neck example involves homes, not a leased battery field
Pepco Holdings’ January 2023 description identifies the Elk Neck pilot as a network of residential batteries in Cecil County, supporting participating homes during outages and the local grid at peak demand. PJM’s December 2021 announcement describes an arrangement involving 110 homes whose batteries could be controlled together.
Those dated accounts explain a particular pilot. They do not establish an open enrollment offer today, a new land procurement or the terms of a separate developer’s proposal. Ask which project the representative actually means if Elk Neck is used to explain an offer to you.
The distinction matters when you compare benefits. A home-battery proposal might involve equipment, electricity use and backup service at your building. A land lease might reserve a fenced compound, vehicle access and a cable route for another company’s grid business. Have the company identify the arrangement before discussing price.
Ask directly: “Would this equipment serve my building, or would I be renting land for your project?” If backup power is promised with a land lease, request an explanation of the actual connection and the service you would receive. Do not assume that benefit from the nearby pilot.

Get the proposed use and review office identified
Start with the parcel location, present use and proposed equipment. Cecil County’s Planning & Zoning Division administers its zoning ordinance and programs including critical areas, floodplains, forest conservation and agricultural preservation. Its department page is a starting contact, not a determination that an independent battery is allowed on your land.
Have the project team ask how its actual proposal would be classified. Equipment serving an existing building, storage added to a solar project and a separate grid facility can raise different questions. Request the explanation used for your property rather than relying on another project’s description.
The county’s building-permit guidance says approval from certain incorporated towns is needed before a county building-permit application. It names Cecilton, Chesapeake City, Charlestown, North East, Perryville and Port Deposit. Confirm the parcel boundary and the responsible offices; that list should not be treated as a complete account of every municipality’s requirements.
For waterfront, wooded or preserved land, describe those features early. Ask the reviewing offices and the team which restrictions affect the proposed equipment area and access. Do not assume that leaving a house untouched avoids review of the land around it.

A permit number tells you an application was received
The county explicitly says the number given at submission does not mean a permit has been approved. If a representative says the project is “in permitting,” ask which application that means, what decision has been made and what is still outstanding.
Request the actual approval record when approval is claimed. Which property, equipment and drawing does it cover? Are there conditions or further steps before work can begin? A receipt, reference number or consultant’s submission should be described as that stage of the process.
For front-of-the-meter storage, the Maryland PSC’s current guidance identifies a separate construction-approval requirement and review pathways. Have the team identify the state route for the proposed project alongside local review and utility connection work. One record should not silently stand in for all three.
Compare the remaining work with the land hold you are being offered. What happens if the company obtains one approval but cannot obtain another? Ask when it must report progress, what would justify an extension and how the land is released if the proposal stops.

Put your retained activities on the same drawing as the proposed fence, equipment, delivery area and cable route. A yard that appears empty may be essential for turning trucks, reaching a barn or keeping a tenant’s access open. Explain when those activities take place.
Identify temporary space separately from land occupied for the operating term. Where would deliveries wait, where would excavated material go and how would workers reach the equipment? Ask when each work area is returned and who repairs damage.
For example, if the battery occupies the rear of a commercial property, have the team show how tenants would still reach loading doors during equipment delivery. Work through that conflict before accepting a land description that includes the shared approach.
Compare rent with the rights the company wants
Ask for a drawing and payment schedule together. Would the company pay for the equipment compound only, or also reserve access, cable corridors and other parts of the property? Identify each area and the duration of its use.
Separate money paid while the company investigates from construction or operating payments. Which event starts each amount? If the offer depends on a utility contract or market revenue, ask what has actually been secured and what happens to your payment if that expectation changes.
Discuss the hold’s effect on your own plans. Would you still be able to renew a tenant lease, sell the property or use an adjoining area? Have the proposed restrictions explained before agreeing to reserve more ground than the current drawing needs.
Keep repair, removal and transfer obligations visible too. Identify the company responsible if equipment is abandoned or the project changes owners. Ask how your recorded rights would be cleared and what security supports restoration. The local pilot’s benefits do not settle those private terms.
