Could my land work?

Fayette County has a named battery development proposal and a recorded August 2026 ordinance amendment. Those records help identify the next questions; they do not qualify every parcel. Ask for the current amended rules, a drawing of the land requested and a timetable that separates connection work, permitting, construction and your payments.

The August 20, 2026 special County Board minutes record approval of an amendment to the Fayette County BESS ordinance. The minutes describe an effort to align county ordinances with changed state legislation. They record an ordinance decision, not a permit for an individual battery project.

The county also publishes its June 2025 battery ordinance. Because that document predates the recorded amendment, do not use its old limits, deadlines or fees as the final answer for a new proposal.

Ask the reviewing office or project team for the amended text in force and an explanation of the route for your parcel. Identify the site by its parcel reference and drawing, rather than relying on a mailing address.

Keep the current ordinance, any application and the eventual project decision together. Each answers a different question. A discussion of general county rules does not establish that a particular design has been approved.

What the KCE IL 2 project page shows

Key Capture Energy identifies KCE IL 2 as a Fayette County proposal. Its published timeline separates an earlier lease and MISO request from anticipated commercial and connection milestones, county application, construction and commercial operation.

Treat that timeline as the developer’s account of its plans. It does not, by itself, prove a completed connection agreement, issued permit or operating project. If the team refers to a completed milestone, ask for the corresponding record.

For your land, first establish whether an approach concerns that proposal or a separate project. Ask what rights are needed and which company would sign and pay under your agreement. Sunland does not claim involvement in KCE IL 2.

A named nearby proposal is not evidence that adjoining acreage is being sought or that a different parcel can use the same connection. A separate site needs its own review.

Compare the project timetable with your payment dates

An option can reserve land while work remains uncertain. Ask for the initial term, every extension and the full period during which the developer could hold the property.

Find out what happens while studies, procurement or applications are pending. What work must the developer complete, what updates do you receive and what payment is due at each stage?

Have the team distinguish a target construction date from the event that starts your lease rent. Ask your adviser how the proposed wording handles delay, an unsuccessful application or a decision to stop.

Keep the land-release process clear. If the proposal does not proceed, you should understand how the commitment ends and what documents or work must be dealt with.

Look at all the land the project would use

Ask for a drawing showing the equipment, road, electrical route and temporary work areas. Mark the fields, buildings, entrances and tenant uses you want to keep.

The older county application provisions show why a battery plan can involve much more than the containers: access roads, construction staging, drainage and related electrical equipment. Use those subjects as questions for the current proposal, rather than treating the old application list as today’s filing instructions.

Explain drainage arrangements you depend on and routes used during planting or harvest. Ask how construction would affect them, who repairs damage and when temporary space is returned.

If a different layout is proposed later, compare it with the land rights you agreed to provide. More equipment, a moved entrance or a longer cable route may require a separate discussion.

Keep safety and operating contacts practical

Ask who would operate the site and whom you would contact about a property problem. Find out how the operator coordinates access with emergency responders and what the owner needs to know.

Discuss ordinary issues too: a damaged gate, blocked entrance, drainage problem or unexpected work. Keep a current contact list and a record of how notices under the agreement must be delivered.

Review removal and restoration responsibilities in the private agreement. Ask what separate plans or security support the project and who can use them. An ordinance amendment does not replace review of the deal you are being offered.
